Immigration Court Filings

This BIA brief was filed in response to the Government's appeal of the Immigration Judge's decision to grant deferral of removal under the Convention Against Torture (CAT). This brief argues that the Immigration Judge correctly considered all the evidence, there was no clear error of factual findings, and the Immigration Judge applied the correct standards as to questions of law.

This reply brief argues (1) The IJ's credibility finding should not be disturbed; (2) The Respondent established a likelihood of torture pursuant to case law; (3) The police officers who shot the Respondent were acting "under color of law."
